If you impersonate someone online, you can be charged with identity theft as a Califorinia judge recently ruled. A teeenager, Rolando S. logged into an the victim’s (a female) email account using a password he got in a text message.

He was able to login to Facebook and alter the victim’s profile as well as post vulgar messages on a couple of male friends walls regarding the victim. Trial court records indicate that the altered profile read as follows: “Hey, Face Bookers, [sic] I’m [S.], a junior in high school and college, 17 years young, I want to be a pediatrician but I’m not sure where I want to go to college yet. I have high standards for myself and plan to meet them all. I love to suck [expletive].”

The Fifth Appellate District Court of Appeals Judge ruled that Rolando S. be detained for 90 days in the Kings County Juvenile Academy Alpha Program. He will also have to serve probation once the 90 day period is completed. The identity theft statue 530.55 was what he violated according to the court. The statue states that those who: “Willfully obtain personal identifying information and use that information for any unlawful purpose, including to obtain, or attempt to obtain, credit, goods, services, real property, or medical information.” have committed identity theft.

The e-personation statue which California has added is different from other US states laws. According to the judge, the law is vague as there is not a requirement to access the password. While the post was supposed to “be a joke” according to the defendants statement, his appeal was denied by the appeals court. So who is the joke on now?
